Customer at Chuck’s Produce was asked to leave for not wearing a mask
VANCOUVER – The Vancouver Police Department issued a news release Thursday in an attempt to clarify facts that have been reported about an incident that took place at Chuck’s Produce & Street Market in east Vancouver.
On Sept. 8, Vancouver Police responded to a call for service at the Mill Plain location of the local grocery store regarding a customer the store manager wanted trespassed for violating store policy.
According to the Vancouver Police officials, several news outlets, including some national outlets, have reported inaccurate information related to the incident.
“Information is circulating and spreading on both social and traditional media that citations were issued by Vancouver Police related to the statewide mask mandate,’’ read the news release. “This is incorrect. No citations were issued by the Vancouver Police Department related to the mask mandate. In fact, no citations were issued at all during this call for service and no one was arrested. Officers were called to remove an unwanted individual from the business and ultimately when the individual refused to leave a trespass warning notice was issued to that individual.’’
The Vancouver Police report included a synopsis of the incident from police reports for case number 2021-018912:
On September 8, 2021 at approximately 1459 Vancouver Police were dispatched to 13215 SE Mill Plain Blvd. regarding an unwanted person. Dispatch notes indicated the unwanted person was asked to leave several times (as she was not wearing a mask, as required by the store) and she refused to do so. The responding officer made contact with the store manager who advised he would like the customer to leave the store. The officer made contact with the customer, who again refused to leave and stated she just wanted to pay for her items. The officer asked the manager if he was willing to accept payment from the customer for her items and the manager stated the store did not want her business and wanted her to leave.
The officer issued the customer, who refused to identify herself, a trespass warning notice, based on her refusal to leave and at the request of store management. The warning notice was provided to the customer and police left. A short time later, dispatch received another call that a group was still in the store being disruptive, filming and causing a disturbance. Store personnel asked that the group be trespassed and removed from the store.
When officers arrived the second time, the store manager made the decision to clear the store of all customers and close temporarily. Vancouver Police assisted store personnel with directing customers out of the store and off store property. There were no citations written or arrests during either of the calls for service to this location.
National news media also inaccurately reported that Vancouver Washington has one of the worst crime rates in the nation. We are not aware of any credible supporting data for the media to make this assertion.

the stones on chucks, expensive as you’ve ever seen, open 6 days a week and half days on Friday, no pork, no alcohol, every day is casual Friday at PJ Mcfunnigans as there is no uniform or dress code. I’m surprised these customers even recognized the employees on shift. Usually they are hanging out in hooded sweatshirts in groups congregating by the apple bin or ( the commons) doing what they can clogging up the produce aisle 1 apple at a time. Your largest shopping base is Eastern European. Most of these people moved here to escape draconian and communist rule and edicts. In order for the “yellow star” comparison to actually be accurate, only targeted people would be required to wear masks, which at this time is required of everyone. If you’re talking about a time when those who have chosen to not be vaccinated were required to wear mask, when those who are vaccinated were not required to wear mask, that too is a false equivalency, as the requirement is not a result of any ethnic trait, but as a result of a choice to not be vaccinated. Just like felons aren’t allowed to vote because of a choice they made, or sex offenders aren’t allowed to live near schools because of a choice they made, those that chose to forgo vaccinations were required to wear masks to protect others.
There are many options for those who don’t want to wear masks to obtain groceries. No one is prevented from obtaining supplies because of the mask mandate.
How then can we interpret the actions of those people at Chuck’s? What I see is people who don’t care about the safety and welfare of their families, healthcare workers and communities. People who are so profoundly selfish that they can’t bear the slight inconvenience of wearing a mask to protect their fellow citizens from harm or death. So selfish that even though they have plenty of other options to obtain their groceries are intentionally putting others at risk because of their entitled behavior. These are people who think the rules don’t apply to them, just like all criminals. They don’t respect private property and the rights of businesses to have requirements for entry, which has always been the case. “No shirt, no shoes, no service”. They are clearly telling us that they don’t care who they hurt or kill because the slight inconvenience of wearing a mask is simply too much to bear even if it endangers others.
All of the hyperbole about “stars” and “Nazis” are nothing but a smokescreen for their lack of generosity and concern for the welfare of others. What’s even more tragic in my view, is they suggest that this narcissism is somehow virtuous. That they are some kind of “freedom fighters”, when it’s quite obvious to everyone with eyes to see that they are just a bunch of “Karens and Kens” who think they are more important than everyone else and think the rules shouldn’t apply to them.

My wife says”we got to support our Christian community.” After this incident, her tune changed and now she tells me that”She no longer wish to support dictatorships.” Please don’t attack my level of education or try to put me down( English is my 5th language and I probably speak it better than you lol) I’m simply obeying my wife. Chucks was a good store up until now. Every time me and my wife go there we would drop couple of hundred dollars in groceries . NOT ANYMORE. My money will be spent elsewhere and I’m hoping other people will do the same. That way buissness will realize if they become the mask nazi’s they will go out of buissnes.

I actually have never shopped at Chuck’s, but I will now, knowing that they care about the safety and welfare of their customers and employees and don’t indulge a bunch of whining toddlers who think they are above the rules.
I was there the whole time, over 90 minutes
it was totally ridiculous and shameful.
I even talked to one of the policemen (Rasmussen) at length explaining that it was against federal and state law for the manager to discriminate against these ladies like they were and that there’s no legal basis for charging us with trespassing unless someone was disturbing the peace or if someone had been individually assessed and determined by a medical professional to be a health threat.
But he disagreed and asserted they didn’t need to have any reason to ask someone to leave.
He did agree that having 12 officers there for this situation was a total waste of time. So I asked why they were there then. he said they had to come because they were called by the manager. nevertheless he still threatened to arrest me and the rest of us three times which they never actually did but they did threaten that which is a bit disconcerting
but I decided to stand My ground on principle and take that chance. When the police officer told me those three times that we were going to be all arrested for trespassing I was outside the store on the sidewalk.
it was such a waste of time and the manager was the only person causing disturbance of the Peace.
the ladies who are trying to buy food were all peaceful and polite and the manager was rude and even assaulted one of the the ladies at to check out.
This whole thing was just shocking and unbelievable
All they had to do was put on a mask or shop online. The rules apply to everyone.

1. This private business has a legal classification as a “public accommodation” according to federal law title III reg 28 CFR 36.104.
A private business serves the public and therefore must abide by all state and federal laws.
No business policy supersedes the law. No governor’s order, Health order, emergency or pandemic supersedes our constitutionally protected rights.
Denial of my service violates several federal laws.
2. Federal law 28 CFR 36.202 prohibits “denial of participation” from this business establishment 36.202 c states that unless I have been individually assessed as a direct threat you cannot exclude me from the same and equal services as others.
3. Denying my service or requiring me to be served outside or be limited to home delivery is a VIOLATION of title 2 3 and 7 of the US civil Right act of 1964.
4. Title III sections 36.202 (a) (b) (c) and 36.203 a, b, c states that I shall not be denied the same participation and equal access everyone else.
The law prohibits you from serving me separately or differently.
5. As such this business is prohibited from unlawful discrimination by denied the entry of any member of the public who is not disturbing the peace.
To do so is a crime of FALSE IMPRISONMENT and you can held personally liable for this crime number.
6. These premises are open to the public and does any charge of “trespasses” is a false accusation as I am complying with all lawful conditions allowing me to remain on these premises.
In conclusion the store is here by notified that state and federal laws make it a crime to deny the rights of an individual. You can be arrested for this crime and held personally liable for criminal and civil damages including fines and jail time. This means you can be personally charged and arrested for this crime regardless of what your manager Governor or health officer says no law or store policy supersedes federal and state law.

Rubin, even crazy CA lifted mask mandates everywhere but LA county. It’s telling and sad how stupid people around here are regarding these masks. We are the state with the most strict mask policy, and we act like this is the norm and it’s obviously the answer. Inslee has been bouncing up on faucis lap since this thing began. Yet our (cases are higher). I don’t trust them is all.
Cases are higher because the vaccine and mask mandate simply doesn’t work, and they require kids who show the smallest symptoms to go into a testing facility likely full of sick people to get tested, and on top of that kids won’t be able to return to school for either 2 weeks of no symptoms or they have to get tested it’s stupid in my opinion.
