Vancouver Police clarifies facts on trespass call for service

Customer at Chuck’s Produce was asked to leave for not wearing a mask

VANCOUVER – The Vancouver Police Department issued a news release Thursday in an attempt to clarify facts that have been reported about an incident that took place at Chuck’s Produce & Street Market in east Vancouver.

On Sept. 8, Vancouver Police responded to a call for service at the Mill Plain location of the local grocery store regarding a customer the store manager wanted trespassed for violating store policy.

The Vancouver Police Department issued a news release Thursday in an attempt to clarify facts that have been reported about an incident that took place at Chuck’s Produce & Street Market in east Vancouver.
File photo.

According to the Vancouver Police officials, several news outlets, including some national outlets, have reported inaccurate information related to the incident.

“Information is circulating and spreading on both social and traditional media that citations were issued by Vancouver Police related to the statewide mask mandate,’’ read the news release. “This is incorrect. No citations were issued by the Vancouver Police Department related to the mask mandate. In fact, no citations were issued at all during this call for service and no one was arrested. Officers were called to remove an unwanted individual from the business and ultimately when the individual refused to leave a trespass warning notice was issued to that individual.’’

The Vancouver Police report included a synopsis of the incident from police reports for case number 2021-018912:

On September 8, 2021 at approximately 1459 Vancouver Police were dispatched to 13215 SE Mill Plain Blvd. regarding an unwanted person. Dispatch notes indicated the unwanted person was asked to leave several times (as she was not wearing a mask, as required by the store) and she refused to do so. The responding officer made contact with the store manager who advised he would like the customer to leave the store. The officer made contact with the customer, who again refused to leave and stated she just wanted to pay for her items. The officer asked the manager if he was willing to accept payment from the customer for her items and the manager stated the store did not want her business and wanted her to leave.

The officer issued the customer, who refused to identify herself, a trespass warning notice, based on her refusal to leave and at the request of store management. The warning notice was provided to the customer and police left. A short time later, dispatch received another call that a group was still in the store being disruptive, filming and causing a disturbance. Store personnel asked that the group be trespassed and removed from the store.

When officers arrived the second time, the store manager made the decision to clear the store of all customers and close temporarily. Vancouver Police assisted store personnel with directing customers out of the store and off store property. There were no citations written or arrests during either of the calls for service to this location.

National news media also inaccurately reported that Vancouver Washington has one of the worst crime rates in the nation. We are not aware of any credible supporting data for the media to make this assertion.

Information provided by Vancouver Police Department.

the stones on chucks, expensive as you’ve ever seen, open 6 days a week and half days on Friday, no pork, no alcohol, every day is casual Friday at PJ Mcfunnigans as there is no uniform or dress code. I’m surprised these customers even recognized the employees on shift. Usually they are hanging out in hooded sweatshirts in groups congregating by the apple bin or ( the commons) doing what they can clogging up the produce aisle 1 apple at a time. Your largest shopping base is Eastern European. Most of these people moved here to escape draconian and communist rule and edicts. Many of these people are still suffering from communist PTSD and probably won’t want to submit themselves to gestapo tactics. Wear the star or be banned and escorted out of the store. Now on to the other 20 grocery stores within a 3 mile radius that doesn’t have hitlers youth working for them. Good luck Chuck.

“Wear the Star” WTF are you talking about you uneducated troll. Wearing a mask in no way comparable to the Nazi atrocities of 80 years ago. Morons like yourself really show the depths of ignorance the human race has found itself in.

Matt’s not the uneducated moron here. Mandates ARE the equivalent of the yellow stars. The police called out 12 cop cars for that incident! A complete waste of taxpayer money. The manager should be fired and Chuck’s should be closed far longer than one day a week for that kind of pathetic service!

Hitler in the Gestapo we’re trying to portray there sorry selves as supreme humans and pure white race. Ttheir purpose was to annihilate, herd innocent people by the thousands into gas chambers and killed them. What we’re doing now is trying to save lives, to curtail this deadly unprecedented virus and ultimately eradicate it. Like it or not this is for your own good . Stay out of the store if you don’t wanna wear a mask you people forget that why do you think you have freedom and the right not to be told what to do so do you private businesses entities airlines schools clinics. They have a right to exercise their freedom and they also have an obligation to protect their staff their patrons passengers students patients. Freedom is a two-way street your freedom stops and come to a screeching halt when you start infringing on my freedom and others freedom and the freedom of the general public the overall good of the people will always prevail and thankfully most all of this country is on board . Unfortunately people like you are too stupid to realize that

Freedom is a two way street? Like the leaky border open for all this infected with corona or not. I wish we could cherry pick which laws to follow like the us govt. apparently a humanitarian migrant crisis isn’t in need of much attention. Open check points. 100,000s coming in. No law enforcement . Meanwhile back at chucks 12 cop for a mom without a mask. If she was a migrant having just walked across the border in Texas they would give her an eBt card and hotel voucher instead of being trespassed. Obligation to protect their staff lol please. They should close down if they think making people wear crusty masks they’ve been carrying around for a week and touched every surface imaginable is all that’s standing between them and an out outbreak.

In order for the “yellow star” comparison to actually be accurate, only targeted people would be required to wear masks, which at this time is required of everyone. If you’re talking about a time when those who have chosen to not be vaccinated were required to wear mask, when those who are vaccinated were not required to wear mask, that too is a false equivalency, as the requirement is not a result of any ethnic trait, but as a result of a choice to not be vaccinated. Just like felons aren’t allowed to vote because of a choice they made, or sex offenders aren’t allowed to live near schools because of a choice they made, those that chose to forgo vaccinations were required to wear masks to protect others.
There are many options for those who don’t want to wear masks to obtain groceries. No one is prevented from obtaining supplies because of the mask mandate.
How then can we interpret the actions of those people at Chuck’s? What I see is people who don’t care about the safety and welfare of their families, healthcare workers and communities. People who are so profoundly selfish that they can’t bear the slight inconvenience of wearing a mask to protect their fellow citizens from harm or death. So selfish that even though they have plenty of other options to obtain their groceries are intentionally putting others at risk because of their entitled behavior. These are people who think the rules don’t apply to them, just like all criminals. They don’t respect private property and the rights of businesses to have requirements for entry, which has always been the case. “No shirt, no shoes, no service”.  They are clearly telling us that they don’t care who they hurt or kill because the slight inconvenience of wearing a mask is simply too much to bear even if it endangers others.
All of the hyperbole about “stars” and “Nazis” are nothing but a smokescreen for their lack of generosity and concern for the welfare of others.  What’s even more tragic in my view, is they suggest that this narcissism is somehow virtuous. That they are some kind of “freedom fighters”, when it’s quite obvious to everyone with eyes to see that they are just a bunch of “Karens and Kens” who think they are more important than everyone else and think the rules shouldn’t apply to them.

they asked her to put on a mask and she flipped out like a toddler having a tantrum. Then she flat out refused and was rude to and causing a scene….heck yes they needed to call the cops. Eff her, and the people who were with her-they are scammers, she wasn’t too sick to wear a mask lol

And if she was that vulnerable why didnt she stay home and let her family take care of it?

Nope, she should have been arrested, she was asked to leave, then told to leave. She chose to be an idiot so the manager stood up for himself and his employees and booted her pathetic self .

My family spends hundreds of dollars every month at chucks. My wife says”we got to support our Christian community.” After this incident, her tune changed and now she tells me that”She no longer wish to support dictatorships.” Please don’t attack my level of education or try to put me down( English is my 5th language and I probably speak it better than you lol) I’m simply obeying my wife. It’s better than obeying dictators at this point. God bless America the land of the free! Free to not be forced to do anything we don’t feel comfortable doing. Simple! Also, please think twice before you insult us from the comfort of your own home. We are both immigrants, and we both know exactly what an oppressed country looks like. This one is moving towards that.

Just remember businesses have their freedom as well. They have their freedom to protect themselves, their staff, their patrons their passengers, patients etc They’re following the same science that you follow when you are injured or very sick or your child is sick you take them to a medical expert a doctor a person with years of education and knowledge. And as far as bringing God and religion into the mix here , let me ask you if you’re a Bible believer.. I think it says somewhere in the psalms “those that lie and deceive will not sit at the throne of God”. . But I find it interesting that most of these Trump believers people that claim to be Christian follow Trump, support him . Trump left office for the final tally of over 30,000 fact checked lies. You might want to ask yourself and your wife if that makes you religious hypocrites religiously conflicted and confused or just delusional?

I’m a believer in god, family and country! Sounds like you’re one of them fake fact checkers that get their science paid for by Zuckerberg and bill gates. I believe It was already proven that Fauci created your man-made virus in a Chinese lab…and here they come to save you with their mask and vaccine mandates. Please be real! We will no longer trust the science that created a virus for maximum human infection. Before trump left office, he warned America about the intelligence service running wild in this country. You may ask yourself, what does the intelligence service have to do with this? Well, the answer to that question is this man-made virus is simply the new brand of weapons. And by the way, if you’re doctors cared about you, instead of giving you prescription drugs and surgery they’d give you a healthy food menu, daily exercise routine and tell you to quit your stressful job. I’m done with these brain-washed dummies! Go wear your masks and get pumped with the Vaccine. If you’re wearing it and vaccinated then you should have nothing to worry about, right? Wrong again…it is proven that the Vaccinated are spreading mutated versions of the Virus. I’m done now!

Do you think Biden is more virtuous? A 40 year politician that’s now in middle stages of dementia , has managed exactly nothing in that time. Now he gets to embarrass us on the national stage with a botched Afghanistan exit. He then killed an aid worker and this 7 kids and told us it what isis. This is just in the last week.I don’t care what you say you are or who you are how if you stand on abortion, you are no murderer. So Biden is less than dirt to me. What do you believe about abortion. I can send you about 1000 bible verses that talk about the sanctity of life and especially of children. If you believe it’s your body your choice. Then take your misquoted cherry picked bible verse and find the ones that talk about stuff like murder aka child sacrifice. Focus on those. Right now no mask is needed in many blue states. No discernible rate in infection decrease. In fact massless California is doing allot better than us. When Science is being enforced by politicians it gets political. Its hard to follow cherry picked edicts blindly where entire municipal and state laws are made to evade federal laws like (sanctuary cities). I watched at Lowe’s as theifs loaded their truck. Employees filming and everyone shouting, they left with a trove of stuff. I spoke to the loss prevention guard they had there. He said cops won’t come. Not enough resource. He said it happens daily. Nothing they can do. Meanwhile back at chucks…. 12 squad cars to escort Karen out of this store for no mask. Surely you must realize the hypocrisy here.

She also takes care of my home, raises my children feeds us the best possible nutrition and never forces her opinions or beliefs on anybody. I’ll vote for this dictator anytime anyway:). Also, God maybe a myth to you, and that’s fine! But he lives in our hearts and minds and we are better people because of it. We’d rather believe in god and what he created for us on earth and in heaven, rather than believe in scientists that feed you chemicals and create viruses for you to live in fear and worship them. I hope this is clear enough.

You are claiming to be a Christian? Then why don’t you care about the health and welfare of your neighbors? Why don’t you respect the civil authorities? Why do you put others welfare before your own? The most disappointing thing in all of this is to see people waving a “Jesus” banner over their petty selfishness and entitled behavior. It’s so defiling to the name of God.

Wearing a mask is such a small inconvenience to protect others. Even if you were right about it not helping, it costs you next to nothing and if you are wrong it could cost someone their life. The fact that you won’t do even this small thing, just proves my point. I have no interest in debating with you or explaining or justifying myself to you. I hope you spend your time teaching other about the dangers of real neglect of health and welfare. If you would put as much time into trolling abortionist as you do someone who doesn’t want to wear a mask you might make a difference. Karthy, you follow so blindly. These same doctors you trust give amphetamines to children to calm them down. They give opiates to people who struggle with addiction many of whom die of overdoses. The second leading cause of death in the us last year was medical malpractice. 250k lives lost. Not maskless idiots. Masked up clown doctors were to blame. Look it up Karthryn. Get on your soapbox and get ready to start shredding doctors. Or do you prefer to go after those that are defenseless?

Given your low opinion of the medical profession, then of course you would NEVER go to the doctor for any purpose whatsoever, nor take any kind of prescription medicine or even an aspirin, right? If you were to get in a car accident, or got cancer or Covid, you’d just handle all that yourself, without any medical intervention, right? Anything else would make you a complete sell out, and entirely belie everything you’ve said here, wouldn’t it?

No one is without error, there are a great many doctors who are opposed to mask and vaccine mandates and many of them liberal. That doesn’t not make them doctors. It almost seems as though your mindset is believe everything or believe nothing. Many choices are more gray than that. You sound like inslee trying to make sure no one gets a religious exemption for using a vaccine developed with aborted fetuses. What does aspirin have to do with masks? Masks are a psuedo science which you yourself admitted there may or may not be some evidence of. Norway, Sweden, Austria etc and about 44 states have no school mask mandates. They recognize the harm these mask are having on children and the lack of evidence they do anything good. Aspirin has been used for decades. Not even close to the same. Like i said. Your chances a car accident are far greater than dying from corona. Yet you still drive. A necessary risk. This is life. Wa and Or are the exception when it comes to these mandates. Yet our Covid cases are higher and continue to be higher than even senior bastion Florida!.
here I’ll suggest co-morbidites. Namely OBESITY and terrible diets. When a quarter of your state is obese. I don’t see any diet mandates. Smoking or alcohol mandates. That’s a public health crisis. The number 1 killer in the us is heart disease. Why don’t we legislate smaller size soft drinks? The answer has always been personal choice. Talk about a public health crisis. I rarely see skinny kids anymore. But once again I’ll make my choices (there are many) and I’ll ask you to do the same. And when one of those doesn’t line up with yours, I won’t go slapping the donut out of your hand and I’ll hope you leave me be.

I was there the whole time, over 90 minutes

it was totally ridiculous and shameful.

I even talked to one of the policemen (Rasmussen) at length explaining that it was against federal and state law for the manager to discriminate against these ladies like they were and that there’s no legal basis for charging us with trespassing unless someone was disturbing the peace or if someone had been individually assessed and determined by a medical professional to be a health threat.

But he disagreed and asserted they didn’t need to have any reason to ask someone to leave.

He did agree that having 12 officers there for this situation was a total waste of time. So I asked why they were there then. he said they had to come because they were called by the manager. nevertheless he still threatened to arrest me and the rest of us three times which they never actually did but they did threaten that which is a bit disconcerting

but I decided to stand My ground on principle and take that chance. When the police officer told me those three times that we were going to be all arrested for trespassing I was outside the store on the sidewalk.

it was such a waste of time and the manager was the only person causing disturbance of the Peace.

the ladies who are trying to buy food were all peaceful and polite and the manager was rude and even assaulted one of the the ladies at to check out.

This whole thing was just shocking and unbelievable

I have the legal right to enter shop and be served at this and any business as protected by law without covering my face

1. This private business has a legal classification as a “public accommodation” according to federal law title III reg 28 CFR 36.104.

A private business serves the public and therefore must abide by all state and federal laws.

No business policy supersedes the law. No governor’s order, Health order, emergency or pandemic supersedes our constitutionally protected rights.

Denial of my service violates several federal laws.

2. Federal law 28 CFR 36.202 prohibits “denial of participation” from this business establishment 36.202 c states that unless I have been individually assessed as a direct threat you cannot exclude me from the same and equal services as others.

3. Denying my service or requiring me to be served outside or be limited to home delivery is a VIOLATION of title 2 3 and 7 of the US civil Right act of 1964.

4. Title III sections 36.202 (a) (b) (c) and 36.203 a, b, c states that I shall not be denied the same participation and equal access everyone else.

The law prohibits you from serving me separately or differently.

5. As such this business is prohibited from unlawful discrimination by denied the entry of any member of the public who is not disturbing the peace.

To do so is a crime of FALSE IMPRISONMENT and you can held personally liable for this crime number.

6. These premises are open to the public and does any charge of “trespasses” is a false accusation as I am complying with all lawful conditions allowing me to remain on these premises.

In conclusion the store is here by notified that state and federal laws make it a crime to deny the rights of an individual. You can be arrested for this crime and held personally liable for criminal and civil damages including fines and jail time. Sorry being barred for refusing to comply with public safety requirements does not qualify. The Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, religion, sex or national origin.

The next time any of you anti-mask clowns go in for surgery, make certain to tell the surgeon and his/her assistants that they do not have to wear masks in your presence.

oh man what a great hypothetical cause everyone car relate to that example. The classic in for surgery ask your nurse to wear a mask and she refuses and you break down cause you can’t get those breast implants you always wanted. Dude most democratic states don’t have a mask policy right now California . Once the rules change you act like you there is no way we can’t wear this. When one day prior and one state over everything is the same or better than here.

This mask mandate has everyone mad, has me kind of mad I have to wear one every single day it’s very annoying my ears are starting to bleed from the bands being around them and it makes my nose feel uncomfortable, masks also don’t make very much difference statistically speaking it’s really not worth the headache to keep this mandate going, whatever the hell happened to 2 weeks to flatten the curb

Rubin, even crazy CA lifted mask mandates everywhere but LA county. It’s telling and sad how stupid people around here are regarding these masks. We are the state with the most strict mask policy, and we act like this is the norm and it’s obviously the answer. Inslee has been bouncing up on faucis lap since this thing began. Yet our (cases are higher). I don’t trust them is all.

Cases are higher because the vaccine and mask mandate simply doesn’t work, and they require kids who show the smallest symptoms to go into a testing facility likely full of sick people to get tested, and on top of that kids won’t be able to return to school for either 2 weeks of no symptoms or they have to get tested it’s stupid in my opinion. And he government is simply bad at their jobs all they care about is money
