
The Complaint alleges deprivation of rights under the First Amendment of the US Constitution and under Washington Constitution
Silent Majority Foundation filed a lawsuit against Washington Attorney General Bob Ferguson, the Attorney General’s Office (AGO), and executive level AGO employees on behalf of 10 former AGO employees who were terminated under the AGO’s policy requiring a COVID-19 vaccine to retain their employment.
Of course, when previously asked about the mandate, the AGO objected to the notion that the mandate was out of place, stating publicly that “[t]he overwhelming majority of the feedback we have heard from our staff is that people feel safer returning to a workplace where people are vaccinated.”
Prior to adoption of the Vaccine Policy, these women successfully worked for the AGO without issue, with many having received awards for their high performance. Several of these women were 10-plus year veterans of the AGO and had won such awards many times over. The Complaint alleges deprivation of rights under the First Amendment of the US Constitution and under Washington Constitution, Article I, Section 3; lack of due process; failure to accommodate; disparate treatment; wrongful termination; and that the Policy was an ultra vires act undertaken outside of the AG’s authority. The Complaint seeks damages, including lost wages and benefits and compensation for emotional distress.
“SMF brought this case as it’s important to remind our elected officials that they have a duty to the Constitution and to the protection of their workers’ rights,’’ said General Counsel Pete Serrano in a statement issued Wednesday. “This is a case where it’s clear that the agency sought to violate the rights of some of its workforce to placate the desires of another portion of its staff. I encourage you to closely follow this case as it addresses several critical elements of the First Amendment of the US Constitution that require vigorous defense by organizations like SMF. Our defense of these rights is extremely critical and necessary, especially when the government is trampling those rights.’’
